BlkBot is an automated trading execution tool. It is not a registered investment advisor, commodity trading advisor (CTA), broker-dealer, commodity pool operator (CPO), or financial institution. Nothing provided by BlkBot constitutes financial, investment, legal, or tax advice. All trading signals, strategies, and automated actions are algorithmic in nature and are not tailored to your individual financial situation, risk tolerance, or investment objectives.
Trading futures contracts involves a substantial risk of loss and is not appropriate for all investors. You may lose some or all of your invested capital. Leverage amplifies both gains and losses. You acknowledge and accept that: (a) past performance of any strategy does not guarantee future results; (b) automated systems can malfunction, produce erroneous signals, or fail entirely; (c) market conditions can change rapidly in ways that cause significant losses; and (d) you are solely responsible for all trading decisions and their financial consequences. You assume full and complete financial risk for all activity conducted through this platform.
To the maximum extent permitted by applicable law, BlkBot and its operators, developers, owners, employees, agents, and affiliates (collectively "BlkBot Parties") shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to: trading losses; loss of profits or revenue; missed trading opportunities; system downtime, outages, or technical failures; data inaccuracies or errors in signals; actions or failures of third-party brokers, exchanges, or data providers; or any other losses arising from your use of or inability to use the platform. This limitation applies regardless of the legal theory under which damages are sought, even if BlkBot has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless BlkBot Parties from and against any and all claims, demands, actions, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of BlkBot; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any trading activity conducted through your account.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF BLAKBOT SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION, NOT IN COURT. Arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. Each party shall bear its own costs unless the arbitrator determines otherwise.
BlkBot is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, completeness, or uninterrupted availability. BlkBot makes no warranty that the platform will meet your requirements or that any signals, strategies, or automated actions will be profitable or free from error.
BlkBot is not registered with the Commodity Futures Trading Commission (CFTC), the National Futures Association (NFA), the Securities and Exchange Commission (SEC), or any other regulatory body. You acknowledge this fact and accept all associated risks. You are solely responsible for determining whether your use of BlkBot complies with applicable laws and regulations in your jurisdiction.
You are solely responsible for ensuring your use of BlkBot complies with all applicable laws and regulations, including but not limited to those governing futures trading, securities trading, taxation of trading gains and losses, reporting requirements, and the use of automated trading systems. BlkBot Parties shall not be liable for any regulatory penalties, fines, or sanctions you incur.
BlkBot interfaces with third-party brokers, trading platforms, data providers, and other services (including but not limited to Tradovate). BlkBot is not responsible for the actions, failures, outages, errors, or terms of service of any third-party provider. Your relationship with your broker is governed solely by your agreement with that broker.
You are solely responsible for all activity that occurs under your account. You agree to maintain the confidentiality of your login credentials and to notify us immediately of any unauthorized access. BlkBot shall not be liable for any loss resulting from unauthorized use of your account.
BlkBot owes no fiduciary duty to you. The platform acts solely as an automated execution tool based on algorithmic signals. No relationship of trust, confidence, or fiduciary obligation is created by your use of BlkBot.
BlkBot may be in a developmental or beta state. The platform may contain bugs, errors, or interruptions. System failures, connectivity issues, API failures, or unexpected behavior may result in missed trades, duplicate trades, or other unintended actions that could cause financial loss. You accept these risks in full.
BlkBot shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God; exchange outages; internet or network failures; broker API failures; regulatory actions; market disruptions; power failures; or civil unrest.
By using BlkBot you consent to the collection and use of your email address and account information for the purpose of operating the platform, sending transactional emails, and maintaining records. We do not sell your personal information to third parties.
BlkBot reserves the right to suspend or terminate your account at any time, for any reason, with or without notice, and without liability to you.
BlkBot reserves the right to modify these Terms at any time. Continued use of the platform following any modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and BlkBot regarding your use of the platform and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. To the extent any dispute proceeds in court (including to confirm an arbitration award), you consent to the exclusive jurisdiction of the state and federal courts located in California.
